Version 1.0 — effective 21 August 2026
These terms cover your use of Painter Reference. They are short on purpose.
By creating an account or continuing to use Painter Reference, you agree to these terms and to the Privacy Policy. If you do not agree, do not use the service.
The service is operated by Boris Pitel, United States ("we", "us").
You need an account to use Painter Reference. You must give a working email address, keep your sign-in details to yourself, and be at least 13 years old.
You are responsible for what happens under your account. Tell us promptly at support@painterreference.com if you think someone else has access to it.
You keep every right you have in the images you upload. Uploading changes nothing about who owns them.
You give us only the permission needed to run the service for you: to store your images, generate previews, show them back to you on your devices, deliver them to people you send them to, and — only when you ask — pass an image to our AI provider for analysis or editing. That permission exists solely to operate the service, and it ends when you delete the content or your account.
We do not use your images to train AI models. We do not sell them, license them, publish them, or show them to anyone you have not sent them to. We claim no ownership of them at any point.
You must have the right to upload what you upload. Do not upload:
We may remove content that clearly breaches this and, for serious breaches, suspend the account responsible. We do not monitor libraries routinely — private libraries are private, as described in the Privacy Policy.
If you send images or messages to another user, you are responsible for what you send. Recipients can block you, and you can block them. Do not use messaging to harass anyone.
Both AI features are optional and never automatic. Each runs only when you ask for it, on the image you ask about.
AI analysis sends the image to our AI provider, currently OpenAI, and returns a description of it. Treat that description as a suggestion, not a fact — it can be confidently wrong. Do not rely on it for anything that matters without checking.
AI editing sends the image and your instruction to the same provider, which generates a new image. The generated image is saved into your library as an associated image alongside the original, and is yours on the same terms as anything else in your library — see clause 3.
Two things to know about generated images. They may not be what you expect; generation is not precise, and an unsatisfactory result is not a fault in the service. And the law on who owns AI-generated images is unsettled and varies by country — in the United States, works lacking human authorship may not be copyrightable. We make no promise that you can claim copyright in an image the AI generated, and you should not rely on doing so.
We try to keep the service running, but we do not promise it will always be available. It may be down for maintenance, and it depends on providers whose outages are outside our control.
Keep your own copies of anything you cannot afford to lose. We take backups, but the service is not an archive and should not be your only copy of an irreplaceable image.
Painter Reference is currently free to use. If we introduce charges, we will tell you first, and no existing free account will be charged without your agreement.
You may stop and delete your account at any time. Deletion removes your images, categories, messages and profile, subject to the short backup window described in the Privacy Policy.
We may suspend or end an account that seriously breaches these terms, or if we discontinue the service. If we shut the service down, we will give you reasonable notice and a way to get your images out.
The service is provided as it is. To the extent the law allows, we are not liable for indirect losses, lost profits, or lost data — which is why clause 7 asks you to keep your own copies.
Nothing here limits liability that cannot legally be limited, including for death or personal injury caused by negligence, or for fraud.
Some countries give consumers rights that cannot be signed away. Nothing in these terms removes those rights.
We may update these terms. If a change is material, we will tell you in the app and ask you to accept the new version before continuing. The version and date at the top identify which one you agreed to, and we keep a record of that.
These terms are governed by the law of the State of New York, United States, and disputes will be heard there.
